Nash Privacy Policy and Notice at Collection

1. Scope of This Privacy Policy
This Privacy Policy applies to:
Nash on Merchant Websites: Information processed when you interact with Nash on an ecommerce website or application operated by a Merchant that uses Nash.
Pier39 AI Websites and Services: Information collected when you interact directly with websites, applications, or other services operated by Pier39 AI.
Business Users: Information relating to merchants, brands, agencies, and other individuals who interact with Pier39 AI in a professional capacity.
When Nash operates on a Merchant’s website, the Merchant may have its own privacy policy that also applies to your interaction with that website. We encourage you to review the Merchant’s privacy policy to understand how that Merchant collects, uses, and shares your information.
2. What Is Nash?
Nash is an AI-powered shopping assistant that interacts directly with shoppers on ecommerce websites. Nash can:
Answer questions about products;
Understand what a shopper is looking for, including preferences, needs, budget, and intended use based on information provided by the shopper;
Recommend products, including complementary products, bundles, and upsells;
Help shoppers compare products;
Provide information about products, pricing, availability, and other shopping-related information;
Apply a discount or coupon code to a shopper’s cart when the shopper requests it or when the shopper qualifies for a Merchant offer; and
Add products or product variants to a shopper’s shopping cart when the shopper asks Nash to do so.
Nash uses artificial intelligence to understand shopper requests and generate responses and product recommendations. Nash does not independently complete purchases or submit payment information on behalf of shoppers.
3. Information Nash Collects or Receives
The information Nash processes depends on how the Merchant has configured Nash, what information the Merchant’s ecommerce platform makes available, and what you choose to provide.
3.1 Information You Provide to Nash
When you interact with Nash, you may provide information such as messages and questions you enter into the chat; product, size, color, or style preferences; budget or price preferences; intended use or occasion; feedback about products; and other information you voluntarily provide during your conversation with Nash.
Nash is intended for shopping assistance. Please do not provide passwords, payment card numbers, government identification numbers, health information, or other sensitive personal information through the Nash chat. See Section 3.7 for how we handle sensitive personal information.
3.2 Account and Customer Information
If you are logged in to a Merchant’s website, Nash may receive information made available through the Merchant’s ecommerce platform, including, where applicable: name; email address; phone number; customer account information; purchase history; order information; products previously viewed; and other information associated with your customer account. The specific information available to Nash depends on the Merchant’s ecommerce platform, integrations, and configuration.
3.3 Shopping and Product Information
Nash may receive information relating to your shopping activity, including products currently being viewed; product pages and URLs; product names, descriptions, prices, variants, and availability; products previously viewed; products recommended by Nash; products you interact with; products you add to your cart; cart contents and value; purchase and order information; and other product catalogue information made available by the Merchant.
3.4 Device and Technical Information
Nash may automatically collect or receive technical information associated with your interaction with Nash, including IP address; browser type; device type; operating system; device or browser identifiers; approximate location; referring URL; current page or URL; date and time of interactions; session identifiers; and other technical information reasonably necessary to operate, secure, and improve Nash.
3.5 Shopping and Behavioral Information
Nash may collect or receive information about how you interact with the Merchant’s website and Nash, including pages and products viewed; product clicks; searches; time spent on pages; cart and add-to-cart activity; checkout activity; repeat product views; navigation between pages; whether Nash was opened or interacted with; interactions with product recommendations; and other events indicating shopping intent or engagement. Depending on the Merchant’s implementation, Nash may also process behavioral signals such as cursor activity, cursor hesitation, page activity, or tab activity.
Nash may associate activity across pages during a shopping session and, where the Merchant makes appropriate account information available, may associate activity with a logged-in customer account.
3.6 Categories of Personal Information Under California Law
For California shoppers, the categories of personal information we may collect, as defined under the California Consumer Privacy Act (CCPA), are set out below.

We do not collect biometric information, sensitive personal information, or the other categories of personal information defined under California law that are not listed above.
3.7 Sensitive Personal Information
Nash is not intended to collect sensitive personal information (such as government identification numbers, precise health information, financial account or payment card numbers, or account credentials), and we ask that you not provide it in the chat. We do not use the Nash conversation to infer sensitive personal information about you. If you voluntarily provide such information, we do not use it to infer characteristics about you and take steps to discard it.
4. Conversations With Nash
When you interact with Nash, we may collect and process your conversation, including messages you send; responses generated by Nash; products discussed and recommended; preferences you express; products or variants added to your cart at your request; feedback you provide; other actions taken through Nash; and technical information associated with the conversation.
Nash uses conversation information to understand your requests, provide responses, generate recommendations, maintain conversation context, operate Nash, troubleshoot issues, and improve the quality and performance of Nash. Depending on the Merchant’s configuration and applicable agreements, information from your interaction with Nash may also be made available to the Merchant.
5. How Nash Uses Your Information
Nash and Pier39 AI may use information collected through Nash to:
Provide and operate Nash and understand your shopping requests;
Answer questions and provide personalized product recommendations, including complementary products, bundles, and upsells;
Apply a discount or coupon code to your cart when you request it or when you qualify for a Merchant offer;
Add products or product variants to your shopping cart when you request it;
Maintain context during a conversation;
Understand shopping behavior and preferences and measure the effectiveness of Nash and its recommendations;
Improve the quality, accuracy, and performance of Nash and analyze how shoppers interact with Nash;
Generate analytics and insights for Merchants;
Identify errors and technical problems, and protect Nash and our systems against fraud, abuse, and security threats; and
Comply with applicable laws and legal obligations and enforce our agreements.
6. Product Recommendations, Discounts, and Add-to-Cart Actions
Nash may use information you provide during a conversation, information about products, and information about your shopping activity to generate personalized recommendations. If you ask Nash to add a product or variant to your cart, Nash may use conversation and product information to identify and add the requested item.
If you ask Nash to apply a discount, or if you qualify for a Merchant offer such as a first-time-customer discount, Nash may apply the corresponding code to your cart. Any such offer is the Merchant’s offer, and the Merchant’s privacy policy governs how any information you provide in connection with it is used. Where a Merchant offers a first-time-customer discount, an email address you provide is used only to check eligibility for that offer and is not retained by Pier39 AI beyond that check.
Nash does not independently complete your purchase or submit payment information on your behalf. Recommendations are generated using artificial intelligence and may not always be accurate, complete, or suitable for your circumstances. You remain responsible for reviewing products, prices, variants, and availability before completing a purchase.
7. Artificial Intelligence and Third-Party AI Providers
Nash uses artificial intelligence models and services provided by third-party technology providers, which may include OpenAI and Anthropic. To generate responses and recommendations, information relevant to your request may be transmitted to these providers for processing. Depending on the service and configuration, this may include messages you submit, relevant conversation context, product and catalogue information, shopping preferences, and other information necessary to generate a response.
Pier39 AI does not use shopper conversations to train or fine-tune its own general-purpose AI models. We do not intentionally use information that directly identifies you to train our own general-purpose AI models. We may use aggregated or de-identified information derived from interactions with Nash to analyze performance and improve our products and services. Processing by third-party AI providers is subject to their applicable terms, privacy policies, and contractual commitments with Pier39 AI.
8. Information We Share; No Sale or Sharing
We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising. We disclose information only to the Merchant whose store you are shopping on and to the service providers that help us operate Nash, as described below.
8.1 Merchants
When Nash operates on a Merchant’s website, information about your interaction with Nash may be provided to or accessible by that Merchant, including preferences you express; products recommended; product interactions; cart- and purchase-related information; conversation information; and other information made available through the Merchant’s ecommerce platform. The Merchant’s own privacy policy governs the Merchant’s independent collection and use of information.
8.2 Service Providers and Subprocessors
We may share information with service providers that help us operate Nash, including providers of cloud hosting; artificial intelligence and machine-learning services; error and application-performance monitoring; analytics; security; data storage; infrastructure; and customer support. These providers may process information as necessary to provide services to us and subject to applicable contractual and legal requirements.
8.3 Legal and Safety Disclosures
We may disclose information when reasonably necessary to comply with applicable law, regulation, legal process, or governmental request; protect the rights, property, or safety of Pier39 AI, our users, Merchants, or others; detect, investigate, and prevent fraud, abuse, security incidents, or illegal activity; enforce our agreements; or establish, exercise, or defend legal claims.
8.4 Corporate Transactions
If Pier39 AI is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to applicable law.
9. Aggregated and De-Identified Information
We may create aggregated, statistical, or de-identified information from information processed through Nash, including trends relating to product preferences, shopping behavior, product demand, recommendation performance, conversion behavior, cart activity, and interactions with Nash. We may use and disclose such information for legitimate business purposes, including analytics, research, product development, benchmarking, and improving Nash.
Where we de-identify information, we take reasonable measures to ensure it cannot be linked to you, we maintain and use it only in de-identified form, we do not attempt to re-identify it, and we contractually require any recipient to do the same. Improvements to Nash developed from de-identified or aggregated data may benefit all stores that use Nash. We will not intentionally use aggregated or de-identified information to identify individual shoppers.
10. Information From Merchants and Ecommerce Platforms
Nash may connect to and receive information from ecommerce platforms and other systems used by Merchants, including product catalogue information; inventory and availability; pricing; product variants; customer account information; cart and order information; purchase history; website activity; and other information made available through the Merchant’s integrations. Nash uses this information to provide shopping assistance and other services requested by the Merchant.
11. Analytics, Error Monitoring, and Service Improvement
We may use analytics, monitoring, and error-reporting technologies (for example, Sentry) to understand how Nash performs and to identify and resolve technical issues. These services may receive technical information, event information, or other information necessary to diagnose errors and improve the reliability and security of Nash. We may add additional analytics or monitoring providers as our services develop, and where required by applicable law we will provide appropriate disclosures and obtain required consent.
12. Cookies and Similar Technologies
Nash or the Merchant’s website may use cookies, local storage, pixels, session identifiers, or similar technologies to operate the service, maintain session context, remember preferences, understand interactions, provide security, and measure performance. Some technologies used in connection with Nash may be controlled or managed by the Merchant or the ecommerce platform on which Nash operates. Your browser, device, ecommerce platform, or Merchant may provide controls over certain cookies or similar technologies.
13. Data Security
We maintain administrative, technical, and organizational safeguards designed to protect information against unauthorized access, use, alteration, disclosure, or destruction. These measures may include encryption in transit and at rest; access controls; role-based access; authentication controls; monitoring and logging; security testing; and incident response procedures. No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security.
14. Data Retention
We keep personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, and no longer. Retention periods vary by the type of information, the purpose for which it was collected, the Merchant’s instructions, and applicable legal requirements. Our retention periods, by category, are:

When information is no longer required, we may delete it, anonymize it, or otherwise process it in accordance with applicable law.
15. Your California Privacy Rights
If you are a California resident, you have the right to:
Know and access the personal information we have collected about you;
Delete your personal information;
Correct inaccurate personal information;
Opt out of the sale or sharing of personal information (note: we do not sell or share your personal information);
Limit the use and disclosure of sensitive personal information (note: we do not collect sensitive personal information); and
Not be discriminated against for exercising any of these rights.
Depending on where you live, you may have additional or different rights under other applicable privacy laws, including rights to request restriction of, or object to, certain processing, to request portability of certain information, and to withdraw consent where processing is based on consent. The availability and scope of these rights depend on your jurisdiction.
Non-Discrimination
We will not deny you goods or services, charge you a different price, or provide you a different level or quality of service because you exercised any of your privacy rights. Standard promotions offered to all shoppers, such as a first-time-customer discount, are not a denial of these rights.
How to Exercise Your Rights
To make a request, email hello@pier39.ai. Because much of the information Nash processes is handled on a Merchant’s behalf, we may direct or forward your request to the relevant Merchant, and if your request relates primarily to information collected through your interaction with Nash on a particular Merchant’s website, you may also contact that Merchant directly. We verify requests against the email address associated with your interaction with Nash. Where a request is submitted by an authorized agent, we require written proof of authorization and may require you to verify your own identity directly before we act.
16. Children’s Privacy
Nash is intended for use by shoppers who are legally permitted to use the ecommerce website on which Nash is provided. We do not knowingly collect personal information from children in violation of applicable law. If you believe a child has provided personal information through Nash in circumstances where such collection is not permitted, please contact us at hello@pier39.ai.
17. International Data Transfers
Pier39 AI is headquartered in the United States. Information processed through Nash may be transferred to, stored, and processed in the United States and other jurisdictions where Pier39 AI or its service providers operate. Where required by applicable law, we use appropriate safeguards for international transfers of personal information.
18. Our Role Under Privacy Law
When Nash operates on a Merchant’s store, Pier39 AI acts as the Merchant’s service provider and processes shopper personal information on the Merchant’s behalf and under its instructions. Pier39 AI acts as a business, for its own purposes, only with respect to de-identified and aggregated data used to maintain and improve the quality of Nash. We do not use one Merchant’s shopper personal information to provide services to another Merchant, and we do not combine shopper personal information across Merchants.
19. Merchant Responsibilities
Nash is generally provided to Merchants as a technology service that processes information on the Merchant’s behalf. Merchants are responsible for providing appropriate privacy notices to their shoppers; for determining the appropriate legal basis and permissions for their collection and use of shopper information; for configuring Nash and their ecommerce platforms appropriately; and for complying with applicable privacy, consumer protection, electronic communications, and other applicable laws. Where required, Merchants may be responsible for obtaining appropriate consent or providing appropriate notice before Nash collects or processes certain information, and for any offers, discounts, or financial incentives they make available through Nash.
20. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to Nash, our services, applicable laws, or our data practices. When we make changes, we will update the “Last Updated” date at the top of this Privacy Policy. Where required by law, we will provide additional notice of material changes.
